dc.description.abstractReconocida la necesidad y legitimidad de las remisiones a la regulación ex-trapenal en el ámbito del derecho penal económico, este estudio pretende delimitar el rol que la norma o el acto administrativo de referencia cumplen respecto del delito, así como la perspectiva desde la cual deben ser interpre-tados. El análisis dogmático permite concluir que se trata de elementos del tipo y que su interpretación debe hacerse según los criterios de la normativa extrapenal, con algunas posibilidades de flexibilización en conformidad con el marco sistemático y teleológico del tipo penal.
dc.description.abstractRecognizing the need and legitimacy of referring to extrapenal regulations within the field of economic criminal law, this study aims to delineate the role that the reference norm or administrative act plays concerning the crime, as well as the perspective in which they should be interpreted. The doctrinal analysis allows for the conclusion that these are elements of the offense and that their interpretation should follow the criteria of extrapenal regulations, with the possibility of some flexibility in accordance with the systematic and teleological framework of the criminal type.
