    Actos y procedimientos en materia de aguas: actividad administrativa formal. Encuentro del derecho administrativo con el derecho de aguas

    Buena parte de la actividad práctica del Derecho de Aguas se desenvuelve a través de la actividad de la Administración Central del Estado, representada principalmente, en materia de aguas, por la Dirección General de Aguas; organismo con atribuciones diversas en este campo y al que deben ocurrir los administrados/particulares para la gestión de diversos trámites, con el objetivo de realizar registros o solicitudes, lo que da lugar a procedimientos regulados por la ley. La actividad jurisprudencial de la Corte Suprema en los años 2011-2014 da cuenta de diversos pronunciamientos al respecto, en los cuales se ha especificado este “Derecho Administrativo de las aguas”.

    Assessment of Water Markets in Chile

    Chile was an early adopter of water rights (WR) markets. WR markets have been documented and are driven by demand from relatively high-valued water uses. WR markets in Chile face many challenges in order for it to deliver its full potential as an efficient water allocation mechanism. The objective of this chapter is to apply the WMRA framework to detect those issues that must be considered in order establish an effective water allocation mechanism based on a WR market. The analysis indicates that although weaknesses exist, Chile has significantly advanced in achieving Trade Step 2 of the WMRA framework.

    Contingent Agreements to Reduce the Impacts of Droughts on Human Water Consumption

    One of the expected impacts of climate change is the alteration of precipitation and temperatures, modifying hydrological regimes and water availability. Faced with these changes, it is essential to adopt measures to guarantee the quantity, quality and continuity of drinking water supply to the population. This chapter proposes an instrument that consists of the design and implementation of pre-agreement contracts for the temporary transfer of water volumes from agriculture to water utilities. The application of the instrument is presented using the Aconcagua River basin and the Valparaíso-Viña del Mar conurbation in Chile as a case study. Through simulation models, the transfers, and economic compensations of a potential application of the instrument are characterized and evaluated considering different future climate scenarios, drought triggers for activation of pre-agreements, compensation scenarios based on human basic water consumption thresholds, and opportunity cost of water used in the agricultural sector.

    Desalinization in Times of Drought

    Several factors are contributing to the increased adoption of desalination. Population growth has significantly impacted areas experiencing water stress, while drought conditions, partly influenced by climate change, are simultaneously affecting many regions that previously considered their traditional water supplies to be sufficient. Meanwhile, the cost of desalinated water has been decreasing as technology evolves and the cost of other sources increases. In Chile, there are currently 22 desalination plants in operation, 6 under construction, 3 with environmental approval, and 12 under preliminary evaluation. The current capacity of the operating plants in Chile is 8200 L/s. However, despite this boom in desalination, its orderly and sustainable economic and environmental development presents significant challenges. In this context, the main regulatory, legal, environmental, social and economic challenges for the sustainable development of desalination in Chile are reviewed, outlining some ideas to advance in them.

    The case of Chile is illustrative of a transition from command and control to market-based management policies, where economic incentives play a significant role in water management. This book deals with drought policy in Chile and other countries. It offers a detailed examination of drought management and policies. It describes, analyzes and evaluates the performance of drought policies, laws and institutions, identifies the main challenges that Chile faces and derives lessons learnt. Expert contributors discuss such topics as Chile’s drought water policy, and the reasoning which explains present challenges.

    El marco jurídico institucional para la implementación del derecho humano al agua en el Ecuador

    El presente artículo describe el marco jurídico institucional del reconocimiento del derecho humano al agua en el Ecuador, con el propósito de contar con el sustento cualitativo para el diseño de una metodología que permita medir la implementación de dicho derecho. Para ello, analiza las circunstancias que influyeron en su consagración y la manera en que las normas deberían emplearse a la hora de garantizar su contenido. La investigación utiliza como base el informe de la Organización de los Estados Americanos sobre el abordaje del derecho humano al agua en algunos países de Centroamérica y lo adapta a la realidad ecuatoriana, así como otros en relación con la inclusión de la población vulnerable. Además, lleva a cabo un análisis exegético, haciendo un recorrido histórico de la protección del agua en Ecuador a nivel constitucional y legal, así como un recuento de los diarios de debates de la Asamblea Constituyente de 2008. Los resultados del estudio se presentan en función de las variables diseñadas por el Relator Especial del Derecho Humano al Agua y al Saneamiento. El trabajo concluye que si bien existe un reconocimiento normativo del derecho al agua, la debilidad institucional influye de manera negativa para su efectiva realización.

    Governance and Drought Management Policies in Chile

    This chapter analyzes the current institutional, governance and drought management situation in Chile, identifying the main authorities and agencies that are legally entrusted with competences in this area, and specifying the main characteristics of these functions. The most pertinent and applicable tools are subsequently reviewed, conducting a thorough conceptual and practical analysis of the declarations of water scarcity zones due to severe drought and agricultural emergency resulting from water deficit. Finally, it examines the existing gaps and challenges in addressing extreme hydrological events that are generally occurring and continue to be managed as emergencies or disasters.

    Este trabajo tiene como objetivo efectuar una sistematización de antecedentes y analizar de manera crítica y propositiva la aplicación práctica de la Ley N° 21.202 y su reglamento, centrándose en la declaración de humedal urbano y sus efectos inmediatos. Ello a fin de identificar las principales fortalezas y debilidades del sistema, extraer lecciones y proponer medidas para mejorar la conservación de estos ecosistemas en un marco de sustentabilidad.

    On cognitive ecology and the environmental factors that promote Alzheimer disease: lessons from Octodon degus (Rodentia: Octodontidae)

    Abstract Cognitive ecologist posits that the more efficiently an animal uses information from the biotic and abiotic environment, the more adaptive are its cognitive abilities. Nevertheless, this approach does not test for natural neurodegenerative processes under field or experimental conditions, which may recover animals information processing and decision making and may explain, mechanistically, maladaptive behaviors. Here, we call for integrative approaches to explain the relationship between ultimate and proximate mechanisms behind social behavior. We highlight the importance of using the endemic caviomorph rodent Octodon degus as a valuable natural model for mechanistic studies of social behavior and to explain how physical environments can shape social experiences that might influence impaired cognitive abilities and the onset and progression of neurodegenerative disorders such as Alzheimer disease. We consequently suggest neuroecological approaches to examine how key elements of the environment may affect neural and cognitive mechanisms associated with learning, memory processes and brain structures involved in social behavior. We propose the following three core objectives of a program comprising interdisciplinary research in O. degus, namely: (1) to determine whether diet types provided after weaning can lead to cognitive impairment associated with spatial memory, learning and predisposing to develop Alzheimer disease in younger ages; (2) to examine if early life social experience has long term effects on behavior and cognitive responses and risk for development Alzheimer disease in later life and (3) To determine if an increase of social interactions in adult degu reared in different degree of social stressful conditions alter their behavior and cognitive responses.
